DEMOLITION NOTICE
Initial Demolition Notice under Schedule 5A of
the Housing Act 1985 (as amended by the Housing Act 2004) (“the
Act”) (“The Notice”)
PROPERTIES AFFECTED
Number 7, 8, 9, 10, 11, 12, 13, 14, 15 and 16
Rigby Terrace, Aiskew, Bedale, North Yorkshire DL8 1DQ
INTENTION TO DEMOLISH
Broadacres Housing Association Limited whose
registered office is at Broadacres House Mount View Standard Way
Northallerton North Yorkshire DL6 2YD an exempt charity (Registrar
of Friendly Societies number 27656R) (“the Landlord”) intend to
demolish the Properties.
REASONS FOR DEMOLITION
To facilitate the construction of replacement
dwellings
PROPOSED DEMOLITION PERIOD
It is proposed that the demolition of the
properties shall be carried out before 1 January 2015
DATE OF EXPIRY OF THE INITIAL DEMOLITION
NOTICE
The notice will cease to have effect of 1
January 2015
EFFECT OF THE INITIAL DEMOLITION NOTICE
During the period of effect of the Notice the
Landlord will not be under any obligation to make a freehold
transfer or lease in respect of any claim of the right to buy in
respect of any of the Properties. However this initial notice does
not prevent any tenant with the preserved right to buy of any of
the Properties from making an application for the right to buy but
such application shall be suspended for the period of this
notice.
RIGHT TO COMPENSATION
There may be a right to compensation under
Section 138C of the Act in respect of certain expenditure incurred
in respect of any existing “Right to Buy” applications.
